  1. Aim and scope of the application.

PROGRES, a commercial business, which through the Internet provides the general public (from now on referred to as the User) with information, details and products (from now on referred to as Contents), through the company’s Web page www.progres.es and subdomains (from now on referred to as the Web).

 The current stipulations and those included in the terms of the contract, which are clearly defined, regulate the terms and conditions of User access, use and contract with regard to the contents available from PROGRES through the company’s website, specializing in the manufacture and marketing of electronic equipment and systems which incorporate the company’s own technology for the purpose of agriculture and livestock farming.

The User who accesses this website acknowledges and accepts the terms and conditions of use and privacy, in all versions as they appear on the web, including any modifications produced, obliging users to access these terms and conditions periodically and / or any additional information to be aware of any changes.

  1. Conditions of Access.

Access to the web is free, without prior authorization, subscription or registration. This condition may be modified at any time, without prior notice.

User registration is required to access certain contents of the web. Any User who accesses the site has the right to register although PROGRES reserves the right to assign the User to a different category to the one initially selected.

Generically, the categories for the User registered on www.progres.es are:

  • Individual: Permitted access to additional information.

  • Professional non customer: Permitted access to additional information with the option to request quotations.

  • Professional customer: Permitted access to all web content with the option to request quotations and place orders.

For the subdomain app.progres.es, any registered User, individual or professional, will be able to place orders.

The User will only be able to contract and place orders providing they are of age and correctly registered on the web. Users must, at their own risk, voluntarily provide PROGRES with their personal details.

PROGRES will provide registered Users with a private access code (login) and password which they will be able to change subsequently. The registered user is obliged to guarantee the confidentiality of their own access code and password. PROGRES is exempt of any liability resulting from improper use or negligence caused by the User’s failure to meet their obligation to protect the confidentiality of their access codes.

  1. Intellectual and industrial property rights.

Fonts, graphic designs, images, photographs, sounds, animations, software, texts, plus any information and content shown on the web are protected by Spanish legislation covering copyrights and patents on behalf of PROGRES or licensed third parties. The reproduction and / or publication, including processing information, distribution, broadcasting, modification, or decompiling all or part of the web, or other legally recognised rights, is strictly forbidden without prior permission in writing from the titleholder. The User can make use of the material which appears on the web solely and exclusively for their own private and personal use, not for any commercial use or illegal activities. All intellectual property rights are reserved exclusively for the use of PROGRES or licensed third parties, to exert compliance with the aforementioned terms and conditions and appropriate use of the content of the company’s web, exercising all civil and criminal action rights against the User in the event of any infraction or failure to comply with to these rights.

  1. Política de Enlaces.

 PROGRES will not accept liability for any damage caused or maybe caused, of whatever nature, arising from the use of information taken from the contents of the web and incorporated programmes. Links and hypertext which, through the web, allow the User to access services offered by third parties, are neither the property of nor under the control of PROGRES, the reason for which PROGRES will not accept responsibility either for the information contained in the same or any ensuing consequences arising from the use of the aforementioned information.

  1. Política de privacidad.

Within the compliance framework of the current legislation regarding Personal Data Protection, as stated in the Organic Law 15/1999 13th December (LOPD), the object of which is to guarantee and protect the treatment of personal data, the fundamental rights of private individuals, particularly as regards honour and personal privacy, PROGRES inform the User of the following::

  • Any personal data the User provides by filling in the contact form or any other means will become part of the files under the ownership of PROGRES which will be duly registered with the Spanish Data Protection Authority. Refusal to provide details classed as obligatory, marked by an asterisk (*) on the data collection form, or explicit and clear refusal to accept the conditions of the present privacy policy means it will be impossible to provide the service requested by the User.

  • The aim of the processing is to provide the services as specified by the User, to correctly identify the User requesting customized services, to carry out statistical studies in order to improve the services offered, to handle basic administration tasks, as well as to provide information, by e-mail or any other means, of anything new, products and services related to PROGRES or associated third party companies, which may be of interest to the User (the last task always identified as such).

  • PROGRES is commitment to treating all User data with confidentiality and will only be passed on to third parties (by third party we mean “Companies associated with PROGRES to supply specific services to PROGRES customers” in order to provide the services requested by the User. In any event prior consent will be requested from the User.

  • The User will be held responsible, in any event, for the truth and accuracy of the information provided. PROGRES reserves the right to deny registered services to any User providing false information, retaining the right to the remaining actions stipulated by Law. 

  • PROGRES declares all measures within the company’s means have been taken to prevent the loss, misuse, alteration, unauthorised access and theft of data provided by the User, according to the level of security applicable, in the company’s installations, systems and files, in accordance with Title VIII of the LOPD regulations (Royal Decree 1720/2007, 21st December ). However, Users must be aware the current Security measures on the Internet are not impregnable.

  • The  User will be exercise rights of access, rectification, cancelation and opposition recognised by  LOPD legislation, of by filing an application, in writing, addressed to PROGRES, the company’s registered office in Bellpuig (Lleida, España), Avda. Urgell nº 23 (CP 25250) or by e-mail to info@progres.es, stating the right you wish to exercise and providing documents confirming your identity.

  1. PROGRES Liability.

The products and services featured on the web are in accordance with Spanish legislation. Access to the web is voluntary and therefore responsibility of the User, who will be liable for any consequences, direct or indirect, resulting from the use of the web, including, without limitation, any adverse economic, technical and/or legal effects, as well as the disappointment of any proceeds generated by our web, obliging the User to indemnify PROGRES from any claims, direct or indirect resulting from such actions.

PROGRES will not accept liability for any damages caused as a result of interference, omissions, interruptions, computer viruses, malfunction and / or disconnections in the operational functioning of this electronic system or any computer devices or equipment belonging to the User, brought about by reasons beyond the control of PROGRES, which may prevent or delay the provision of services or web browsing, or any delay or blocking, caused by faults or overloading of Internet or any other electronic systems, nor the incapacity to provide the service or allow access for reasons not attributable to PROGRES, due to the User, third parties or on the grounds of force majeure. PROGRES basically has no control over the User’s use of the web. In particular, PROGRES will not accept responsibility, under any circumstances, to ensure the User makes use of the web in accordance with the law, current stipulations, generally accepted ethics and good practice and law and order, or that the User acts with diligence and prudence.

The civil liability of PROGRES for products supplied is limited to the cost of the product. As such, the User renounces the right to place any liability on PROGRES, for any reason, with any form of dissatisfaction with the products supplied through the web, as well as potential faults, delays or errors accessing the web, including loss of data, or other information that may exist in the User's computer or network.

  1. User obligations.

In general, the User is obliged to comply with the current stipulations as well as comply with the warnings or any contract instructions contained in the web and acting at all times in accordance with the law, morality and the requirements of good faith, using due diligence, and refraining from using the website in any way that may impede, damage or impairment to the normal functioning of the web, property or rights of PROGRES, its suppliers, other web Users any other third party. Access and use of the website to minors is prohibited. Access and use of the portal by minors is prohibited. PROGRES will not accept responsibility for the veracity and exactitude of any data filled in by the User and is therefore unable to confirm the age of the same.

Specifically, and without implying any restriction to the previous paragraph during the use of the website, the User’s obligations are as follows:

b) Do not enter, store or transmit on or from the web, any information or material deemed libellous, offensive, obscene, threatening, racist, incites violence or discrimination based on race, sex, ideology, religion or in any way prejudicial to morality, law and order, fundamental rights, civil liberties, honour, privacy or the reputation of third parties and current regulations in general.

c) Do not enter, store or transmit any program, data, virus, code, or any other electronic or physical device through the web liable to cause damage to the same, or any PROGRES services or equipment, systems or networks, any other user, PROGRES suppliers or any third party in general.

d) You must ensure you keep the "login" and "password" provided by PROGRES safe and take full responsibility for any damages caused by any improper use of the same.

e) Do not use the web for the purpose of advertising or commercial operations, nor must you use the contents and information of the web for publicity purposes or send messages for any other commercial purpose, or to collect or store personal data of third parties, in the absence of express authorization.

f) Do not use false identities or assume the identity of others when using the web or in the use of any of the services on the web, including the use of passwords or access codes of third parties or any other means.

g) Do not destroy, amend, use for your own purpose, misuse or damage any data, information, programs or electronic documents owned by PROGRES, its suppliers or third parties.

h) Do not enter, store or transmit any content through the store website which infringes any intellectual or industrial property rights or business confidentiality appertaining to PROGRES or third parties, or any content which, in accordance with the law, has no right to be at the disposal of third parties.

i) Respect all advice and recommendations from PROGRES, as product manufacturer or manufacturers of complementary products (mainly sensors and accessories).

  1. Invalid and ineffective clauses.

If any clause included in these Terms and General Conditions of Sale is deemed to be totally or partially null and void, this ineffective clause will only affect the aforementioned provision or part thereof deemed to be unenforceable and, by not being included, will leave the remaining Terms and General Conditions or part thereof with such provision as to remain enforceable.

  1. Applicable legislation and jurisdiction

The present website and its content conform to Spanish legislation.

The language is Spanish.

In the event of any conflict or discrepancy in the interpretation or application of the present regulations, the parties will agree to surrender to the jurisdiction of the courts Juzgados y Tribunales de Lleida (Spain), renouncing any other code of law. In the event the User resides outside Spain, they will agree to surrender to the jurisdiction of the courts Juzgados y Tribunales de Lleida (Spain) renouncing any other corresponding code of law.
